It’s not over ’til the fat board sings – and, until she groans, you can chime in. The new regulations cannot be put into effect until you have a chance to comment on them. The time for those comments runsopera-singer out soon.

VOICE YOUR THOUGHTS – This Week.

Written comments on the proposed regulations can filed by any home inspector.

Isn’t it time you told the KBHI what you think? Complaining about what the board coulda shoulda done is a waste, if you are giving them the silent treatment.

Written comments are due February 1, before the close of business at 4 p.m.

You can also let the Board know you would appreciate notification from the Board any time it changes the regulations again. In fact, a notice from the Board, in plenty of time to send in comments, would be a lot more respectful than trying to keep the whole thing secret. Everything else is coming out of the closet these days!

You can comment about absolutely anything in the regulations.
Written comments do not fall into a black hole. State law requires the KBHI to talk over every comment.

Then the Board must pass a written “Statement of Consideration.” The Statement has to explain why the board disagreed, or agreed – and changed the proposed regulation. When the Board was at the Dept. of Housing, Buildings, and Construction, where it belonged, their full-time staff lawyers gave it a written memo explaining what that means. “The agency must submit responses to each and every comment received …during the comments period, even if the comment was “GREAT JOB! This amendment is exactly what the Commonwealth needs,” DHBC General Counsel Dawn Bellis pointedly advised. That is the rule.

It is not too late to comment. But it will be soon. So comment now, if you have any thoughts on the regulations.

Dealing with the licensing board sometimes feels like seeing blue lights blinking in your rear view mirror. It’s not. Most board members basically think nobody cares what they do. Not that the Board is tuned in.
The Board makes no effort to find out what home inspectors think about proposed regulations like these. It never sent out an email to all home inspectors asking if any changes were needed, or what those changes might be. The Board never notified licensed home inspectors it was changing the rules. And, hanging on to that undercover style, the Board has not emailed home inspectors with a notice of the public hearing, or this short time period to file written comments.

It is fair to wonder – Exactly how stupid does this KBHI think every prior board was, that all their work on regulations was such a flop?

On the flip side of that coin, all those prior board members might wonder “how did we screw up so badly that this board needs to write all this stuff?”

In fact, it does not take long for anyone to start wondering – “Exactly what is going on here?” No one ever wrote a single letter or email to the board asking for any of these regulations. So why go through all this – again?

Written comments are filed by sending them to Megan Woodson, Board Administrator, Kentucky Board of Home Inspectors, Division of Occupations and Professions, 911 Leawood Drive, P.O. Box 1360, Frankfort, KY 406091. If you email comments to Ms. Woodson, at [email protected], be sure to get a hardcopy in the mail postmarked by Feb. 1.

If you have any questions on the comments, or the rules, you know PLI is always there to lend a hand.
